I already have a Trust. Why might I need another one?
The type of trust that most people have is a revocable living trust and there are a lot of misconceptions about what the benefits are of a revocable trust and what it actually does for a person. A revocable trust does not provide any sort of protection from the government, from long-term care cost, from liability if he gets in a car accident. Everything in a revocable trust is available to the person who set the trust up, therefore it’s available to their creditors, it’s available to the nursing home, and it’s available to the government. And so in an elder law planning context and a long-term care context, we’re often times going to be using irrevocable trust which are much more powerful provided that it’s properly done, irrevocable trust can get a person’s asset out of their name but still have them in there, have their control and have those assets within reach, perhaps indirectly, but it takes them off the table from being able to have those assets lost to the cost of long-term care. Often times we are going to put a house in an irrevocable trust, and we’re going to put a farm, a family farm, the ranch, the rental properties, maybe CDs. All these sort of things can go into an irrevocable trust and as part of a comprehensive plan to protect those assets but yet leave them in the family, in the control of the family, and have them where they are out of reach of the government. And it can be very useful, very helpful and a real life saver for a lot of folks.
